E-Gift Card Terms & Conditions

These Terms and Conditions (Terms) apply to the purchase and redemption of digital e-gift cards (E-Gift Cards) issued by V3 Apparel Limited (company number 11425294), a company registered in England and Wales (we, us, our). Our website is v3apparel.com.

By purchasing an E-Gift Card you confirm that you have read and agree to these Terms and our general Terms and Conditions available at v3apparel.com/pages/terms-conditions.

In the event of any conflict between these Terms and the general Terms and Conditions, these Terms shall prevail in relation to E-Gift Card purchases and redemptions.

1. About our E-Gift Cards

V3 Apparel E-Gift Cards are digital products only. No physical card is produced or sent. Upon purchase, the E-Gift Card is delivered by email to the email address provided at the time of order.

E-Gift Cards are issued and managed through Shopify's gift card system. The 16-character redemption code is unique, randomly generated and cannot be customised.

E-Gift Cards can be used as payment towards purchases at v3apparel.com only. They cannot be redeemed in any physical store or through any third-party retailer.

2. Who can purchase

2.1 Consumers

Individual customers may purchase E-Gift Cards for personal use or as a gift for another person.

2.2 Businesses

Businesses may purchase E-Gift Cards for third parties including staff, customers and suppliers.

2.3 Restrictions

E-Gift Cards must not be purchased for resale or for use in commercial, promotional or marketing activities without our prior written consent. E-Gift Cards cannot be transferred for value or redeemed for cash.

3. Placing an order

E-Gift Cards can be purchased at v3apparel.com. By placing an order you are making an offer to purchase an E-Gift Card subject to these Terms. You are responsible for ensuring that the email address entered at checkout is accurate. V3 Apparel accepts no liability for E-Gift Cards delivered to an incorrect email address due to customer error.

You will receive an acknowledgement email when your order is received. Acceptance of your order and formation of a contract between us occurs when we send the E-Gift Card to the email address provided. V3 Apparel reserves the right to refuse any order.

4. Right to cancel — important notice

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a 14-day right to cancel digital content purchases. However, by purchasing an E-Gift Card and requesting immediate delivery to your email address, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right to cancel once the E-Gift Card has been delivered.

Orders for E-Gift Cards cannot be amended or cancelled once placed. We do not offer refunds on E-Gift Card purchases except where required by law.

5. Redemption

5.1 Where to redeem

E-Gift Cards are redeemable at v3apparel.com only. They are valid for all countries to which V3 Apparel ships. For a current list of shipping destinations please visit v3apparel.com/pages/v3-apparel-delivery-locations.

5.2 How to redeem

To redeem your E-Gift Card enter the unique code from your gift card email at the checkout page and click apply. Gift card codes are not case sensitive.

5.3 Multiple E-Gift Cards

Multiple E-Gift Cards can be applied to a single order. Enter each code separately and click apply after each one before entering the next.

5.4 Partial redemption

If the order total is less than the E-Gift Card value, the remaining balance will be retained on the E-Gift Card for future use. If the order total exceeds the E-Gift Card value, the remaining balance must be paid by debit card, credit card, PayPal or another E-Gift Card.

5.5 Use with discount codes

E-Gift Cards can be used in combination with valid discount codes. Discount codes cannot be used to purchase E-Gift Cards.

5.6 Restrictions on use

• E-Gift Cards cannot be used to purchase other E-Gift Cards
  
  

• E-Gift Cards cannot be reloaded once the balance has been fully spent
  
  

• E-Gift Cards cannot be exchanged for cash
  
  

• E-Gift Cards cannot be resold or transferred for value
  
  

• E-Gift Card balances apply to the total order value including taxes and shipping
  
  

6. Currency conversion

E-Gift Cards are issued in GBP. If you redeem an E-Gift Card from a non-GBP currency storefront, the value will be converted at the applicable exchange rate at the time of redemption. V3 Apparel has no control over exchange rate fluctuations.

7. Checking your balance

You can check your E-Gift Card balance by clicking the link in your gift card email, which will take you to your gift card page on our website showing the current balance and remaining value.

Alternatively you can contact us at support@v3apparel.com and we will provide your current balance. Our operating hours are Monday to Friday 9am to 5pm.

8. Expiry

E-Gift Cards expire 12 months from the date of purchase. Any remaining balance after the expiry date will be forfeit. The expiry date is stated in the gift card email you receive at the time of purchase.

If your E-Gift Card has expired and you believe this is an error or wish to discuss your balance, please contact us at support@v3apparel.com.

9. Refunds for purchases made using an E-Gift Card

If you return an order that was paid for in full or in part using an E-Gift Card, the refund will be applied back to the original E-Gift Card. If the original E-Gift Card has expired at the time of the return, V3 Apparel will issue a new E-Gift Card to the value of the refund.

10. Lost, stolen or damaged E-Gift Cards

Please keep your E-Gift Card details secure. Once the E-Gift Card email has been delivered to the address you provided, V3 Apparel cannot be held liable for any E-Gift Card that is lost, forwarded to a third party or used without your permission.

V3 Apparel cannot offer cash, credit or replacement for a lost or stolen E-Gift Card. If you believe your E-Gift Card has been used fraudulently please contact us immediately at support@v3apparel.com.

11. Fraud and misuse

V3 Apparel reserves the right, without notice, to cancel or void any E-Gift Card, refuse redemption, suspend or terminate a customer account or seek alternative payment where we reasonably suspect that an E-Gift Card has been obtained, used or applied fraudulently, unlawfully or in violation of these Terms.

12. Payment for E-Gift Cards

Payment for E-Gift Cards must be made by credit card, debit card or PayPal at the time of order. V3 Apparel will conduct fraud and security screening on all E-Gift Card orders. By placing an order you authorise V3 Apparel to carry out these checks.

13. Our liability

13.1 Liabilities not excluded

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability that cannot be limited or excluded by law.

13.2 Excluded liabilities

Subject to clause 13.1, V3 Apparel will not be liable for any loss of profits, loss of revenue, loss of data, loss of business opportunity, loss of anticipated savings or any indirect or consequential loss arising in connection with an E-Gift Card.

13.3 Limitation of liability

Subject to clause 13.1, our total liability to you in connection with an E-Gift Card will not exceed the face value of that E-Gift Card.

14. Branding

Any use of V3 Apparel's logo, trademarks or branding in connection with E-Gift Cards for promotional or campaign purposes requires our prior written approval.

15. Indemnity

You agree to indemnify and hold harmless V3 Apparel, its directors, officers, employees and affiliates from any third-party claims, liability, damages or costs arising from your use of an E-Gift Card or your breach of these Terms.

16. Variation

V3 Apparel reserves the right to amend these Terms at any time. The Terms in force at the time of your purchase will govern that transaction. Continued use of E-Gift Cards after any amendment constitutes acceptance of the revised Terms.

17. Invalidity

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Where possible, any unenforceable provision will be interpreted to most closely reflect its original intent.

18. Waiver

If V3 Apparel fails to enforce any right under these Terms on any occasion, this does not constitute a waiver of that right on any subsequent occasion.

19. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
